World has travelled far from the punitive approach to the crime towards the reformative approach in the contemporary times. But in this reformative era, penal policy in India contains the provision of Death Penalty for various offences. The Constitutional Validity of Death Penalty in India has been challenged in the backdrop of Article 21: The Right to Life and has been established by the Apex Court in Bachan Singh V. State of Punjab. The Court gave the Rarest of the Rare Case Doctrine that over the period of time become a topic of debate with the allegation of arbitrary application of it in the cases of capital offences. Death Penalty, its execution and the necessity in the Penal Law thus become the most to be researched issue when abolitionists and the retentionists strongly put forth their views in the matter.

The book is a serious attempt to study the jurisprudence of Death Penalty and its evolutionary history in the Indian Laws. None of the aspects of Death Penalty is omitted in this work. About The Author

The author, Dr. Shilpi Sharma, completed her School education with CBSE Board in Mathura, graduated from Agra University and holds a Master’s degree in English Literature. She did her LL.B. and LL.M. (Criminal Law) from Veer Narmad South Gujarat University, Surat, Gujarat. She was awarded the Ph.D. degree from the same university.

Dr. Sharma started her career as a practicing advocate in the year 2004 and had been on the Panel of Employees Provident Fund Organisation (Regional Office, Surat) representing the organization in various Courts. She joined Academics in the year 2010 and has cleared UGC-NET and Gujarat-SET in the subject Law. She had worked with V.T. Choksi Sarvajanik Law College, Surat as a Lecturer.

She has now been associated with AURO University, Surat, Gujarat since 2014 and presently serving as an Associate Professor in the School of Law.

Her areas of interest include the Substantive Criminal Law, Constitutional law and other Public Laws.
